TMA appreciates that the demands of business may necessitate a change in plans. Since TMA is a services-only company, late cancellations present opportunity costs. Cancellation requests received less than 30 business days prior to a scheduled service start date will forfeit 25% of the affected event’s service fee. Cancellation within 15 business days prior to a scheduled service start date will forfeit 50% of the affected event’s service fee. Cancellation within three business date forfeits the full fee for the affected event.
TMA shall not be responsible for any failure to comply with, or for delay in performance of the terms of this Agreement where such failure or delay arises from (i) acts of nature, (ii) acts of the Government in its sovereign (and not contractual) capacity, (iii) fires, (iv) floods, (v) epidemics, (vi) quarantine restrictions, (vii) strikes, (viii) freight embargoes, (ix) unusually severe weather, or (x) sudden or extreme illness or injury of primary instructor. In all such events where performance is delayed or prevented, TMA will exert reasonable and diligent efforts to remove said causes and resume performance hereunder. In any such case, TMA's liability will not extend beyond the amount of the service fees paid.
